Terms of Service

1. Acceptance of Terms

By using ProLocal ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. What ProLocal Is

ProLocal is an online marketplace that connects homeowners in Orange County, California with independent local contractors. ProLocal is not a contractor, does not employ contractors, and does not perform any home services. ProLocal acts solely as a technology platform to facilitate introductions between homeowners and contractors.

3. For Homeowners

  • Submitting a service request is free
  • ProLocal does not guarantee that any contractor will respond to your request
  • ProLocal does not guarantee the quality, timeliness, or outcome of any work performed by a contractor
  • You are solely responsible for evaluating, hiring, and paying contractors
  • You agree to leave honest, accurate reviews based only on real experiences
  • Your contact information will only be shared with contractors who have paid to access your lead

4. For Contractors

  • Contractors pay a per-lead fee upon accepting a lead: $25 for Plumbing and Electrical, $15 for all other trades
  • Lead fees are charged to the card on file at the moment of lead acceptance
  • Lead fees are non-refundable once homeowner contact information has been unlocked, regardless of whether the job is completed
  • Up to 3 contractors may purchase the same lead
  • Contractors must maintain valid state licensing and general liability insurance for their trade at all times
  • Contractors are independent businesses, not employees or agents of ProLocal
  • ProLocal reserves the right to suspend or remove any contractor account for poor reviews, homeowner complaints, misrepresentation, or violation of these terms
  • Contractors agree not to misrepresent their qualifications, licensing status, or insurance coverage

5. No Subscription

ProLocal operates exclusively on a pay-per-lead model. There are no monthly fees, subscriptions, or recurring charges. You are only charged when you choose to accept a lead.

6. Payments and Billing

All payments are processed securely through Square. By providing payment information, you authorize ProLocal to charge your card on file for lead fees at the time of lead acceptance. ProLocal does not store your full card details on our servers.

7. Contractor Independence

Contractors using ProLocal are independent businesses. ProLocal does not supervise, direct, or control the work performed by any contractor. Any dispute regarding workmanship, payment, or conduct must be resolved directly between the homeowner and contractor. ProLocal may, at its sole discretion, assist in mediation but is not obligated to do so.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROLOCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM CONTRACTOR SERVICES, DISPUTES BETWEEN USERS, OR LOSS OF DATA. PROLOCAL'S TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO PROLOCAL IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless ProLocal, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or any dispute between you and another user of the Platform.

10. Privacy and Data

ProLocal collects name, email, phone number, and zip code from homeowners and contractors. Homeowner contact information is only shared with contractors who have paid for a lead. Contractor profile information including name, business name, trade, license number, portfolio photos, and reviews is publicly visible. ProLocal does not sell your personal information to third parties. By using the Platform you consent to this data collection and use. California residents have additional rights under the California Consumer Privacy Act (CCPA) including the right to request deletion of their data by contacting us at support@prolocalhome.com.

11. Prohibited Conduct

Users may not: submit false or fraudulent service requests, misrepresent qualifications or licensing, harass or threaten other users, attempt to circumvent the Platform to avoid lead fees, post false reviews, or use the Platform for any unlawful purpose.

12. Intellectual Property

All content on the Platform including design, text, graphics, and code is owned by ProLocal. You may not reproduce or distribute any part of the Platform without written permission.

13. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.

14. Changes to Terms

ProLocal reserves the right to modify these Terms at any time. We will notify users of material changes by updating the date at the top of this page. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
